In Spain the different Statutes of Autonomy are undergoing substantial revision. That revision is being made with repeated invocations of the federal model, without noticing that it would never permit a process in which the federated pieces did not form a whole with the federal pieces. There must first exist an overall agreement on such fundamental questions as competencies, financing, institutional relations, etc. Lacking such an agreement at the political level, the situation must be corrected at the legal level. In (...)

  10. Francisco de Vitoria and Alberico Gentili on the Legal Character of the Global Commonwealth.Andreas Wagner - 2011 - Oxford Journal of Legal Studies 31 (3):565-582.
In discussing the works of 16th-century theorists Francisco de Vitoria and Alberico Gentili, this article examines how two different conceptions of a global legal community affect the legal character of the international order and the obligatory force of international law. For Vitoria the legal bindingness of ius gentium necessarily presupposes an integrated character of the global commonwealth that leads him to as it were ascribe legal personality to the global community as a whole. But then its legal status and (...)

In this paper, I will examine the notion of an epistemic dilemma, its characterizations in the literature, and the different intuitions prompted by it. I will illustrate that the notion of an epistemic dilemma is expected to capture various phenomena that are not easily unified with one concept: while some aspects of these phenomena are more about the agent in a certain situation, other aspects seem to be more about the situation as such. As a consequence, incompatible intuitions emerge concerning (...)

This chapter takes up, in six sections, issues of realism and of ontological and conceptual relativity. Section 1 briefly lays out the kind of absolutist realism of interest in what follows. Section 2 considers arguments against ordinary commonsense entities such as bodies, and for the view that subjects enjoy a superior ontological position. No such argument is found persuasive. I find no good argument against ordinary bodies or other common-sense entities, nor any good argument that subjects enjoy any ontological superiority. (...)

A history and theory of the social sciences: not all that is solid melts into air.Peter Wagner - 2001 - Thousand Oaks, Calif.: SAGE.
Divided into two parts this book examines the train of social theory from the 19th century, through to the `organization of modernity', in relation to ideas of social planning, and as contributors to the `rationalistic revolution' of the `golden age' of capitalism in the 1950s and 60s. Part two examines key concepts in the social sciences. It begins with some of the broadest concepts used by social scientists: choice, decision, action and institution and moves on to examine the `collectivist alternative': (...)

In “Tracking, Competence, and Knowledge,” Ernest Sosa notes that in attempting to account for the conditions for knowledge, externalists have proposed that the justification condition be replaced or supplemented by the requirement that a certain modal relation be obtained between a fact and a subject's belief concerning that fact. While assessing attempts to identify such a relation, he focuses on an account labeled “Cartesian‐tracking”, which accounts for the relation in the form of two conditionals. If a person S believes (...)

The e-value of a hypothesis H, ev, is a Bayesian epistemic, credibility or truth value defined under the Full Bayesian Significance Testing mathematical apparatus. The questions addressed concern the important issue of how the truth value of H, and the truth function of the corresponding FBST structure M, relate to (...)

The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

This paper considers the place of reasons in the metaphysics of epistemic normativity and defends a middle ground between two popular extremes in the literature. Against members of the ‘reasons first’ movement, we argue that reasons are not the sole fundamental constituents of epistemic normativity. We suggest instead that the virtue-theoretic property of competence is the key building block. To support this approach, we note that reasons must be possessed to play a role in the analysis of central epistemically normative (...)

Taking his critique of totalitarianizing conceptions of community as a starting point, this text examines Jean-Luc Nancy's work of an ‘ontology of plural singular being’ for its political implications. It argues that while at first this ontology seems to advocate a negative or an anti-politics only, it can also be read as a ‘theory of communicative praxis’ that suggests a certain ethos – in the form of a certain use of symbols (which is expressed only inaptly by the word ‘style’) (...)

Rigidity.David Sosa - 2006 - In Ernest Lepore & Barry C. Smith (eds.), The Oxford Handbook of Philosophy of Language. Oxford University Press.
For an expression to be rigid means that it refers to one and the same thing with respect to any possible situation. But how is this in turn to be understood? An example will help us work through the definition. Take a word like ‘Aristotle.’ That word is a proper name; and proper names are a clear case of a type of word that refers. ‘Aristotle’ refers to a particular person, the last great philosopher of antiquity; in general, a name (...)

In this paper, we first provide an analysis of the kinds of definitions that are distinguished in these books and a few other papers, and we then propose a systematic comparison of Schlick’s and Carnap’s diverging conceptions of definitions in the 1920s, (...)
