In Spain the different Statutes of Autonomy are undergoing substantial revision. That revision is being made with repeated invocations of the federal model, without noticing that it would never permit a process in which the federated pieces did not form a whole with the federal pieces. There must first exist an overall agreement on such fundamental questions as competencies, financing, institutional relations, etc. Lacking such an agreement at the political level, the situation must be corrected at the legal level. In (...) Germany, which has been the great model for Spanish constitutional design, the notion of constitutional loyalty has been a key element, developed, among others, by the Federal Constitutional Court. The Spanish Constitutional Court, however, until now has not gone into the sacramental foundation of the principle, there where it hides its ultimate authority and, therefore, it finds itself detained for the moment at the starting point of a road it has yet to cover. Because loyalty is the hinge of the state, the lubrication that “serves to facilitate movement”, it reconciles the pieces of the decentralised federal system (federal, regional, or whatever you want to call it). Loyalty acts as the backdrop, which is what in the theatre strictly speaking closes the scene, giving sense to the whole set. (shrink)

Este artículo aborda el papel que juega la “admiración” en la traducción heideggeriana de tres pasajes de la Metafísica de Aristóteles. Con base en el volumen 62 de la Gesamtausgabe, se muestra que la “admiración” se relaciona con tres temas fundamentales, a saber: el mundo, la vida y la comprensión. En primer lugar, analizo el tema del mundo compartido y del mundo circundante. En segundo lugar, describo el tema de la vida, la cual es interpretada como “premura insoslayable” y “clara (...) permanencia tranquila”. En tercer lugar, desarrollo el tema de la comprensión en tres fases: “epistémica”, “propia” y “visible”. Estos temas serán retomados en trabajos ulteriores como Ser y tiempo. Por tal motivo, las lecciones de 1922 son valiosas para conocer el itinerario filosófico de Heidegger en los años veinte. Finalmente, se intenta mostrar que la triple traducción del vocablo griego θαυμάζειν realizada por Heidegger, obedece a un criterio específico de interpretación fenomenológica acorde a los temas mencionados. O positivismo jurídico é predominantemente ensinado e aplicado há décadas por profissionais da área jurídica brasileira, geralmente com referência à construção teórica de Hans Kelsen (1881-1973), deixando à margem muitos outros estudos que oferecem importantes formulações e conceitos para a compreensão do Direito contemporâneo. Este artigo se junta a algumas poucas pesquisas sobre outros referenciais teóricos acerca do positivismo jurídico, analisando a regra de reconhecimento no pensamento teórico de Herbert Hart (1907-1992), apresentando-a como incremento e superação da teoria imperativista de (...) John Austin (1790-1859). A partir de pesquisa bibliográfica, mostramos que, em Hart, a regra de reconhecimento (modalidade de regra secundária) apresenta-se indispensável para a certeza necessária ao Direito, bem como para aferir a validade do sistema jurídico. El presente ensayo explora el itinerario de la crítica que Nietzsche ejerció sobre el arte de Wagner en tres pasos. Primero, se trata de reconocer la juvenil admiración del filósofo por la ópera wagneriana entendida como un renacimiento del drama musical antiguo. Luego, se explora el tránsito hacia su desilusión en la clave de la influencia de Schopenhauer sobre Wagner. Finalmente, el ensayo remata en la crítica madura de Nietzsche sobre Wagner, donde se advierten los prolegómenos decimonónicos (...) de la transformación general del arte en espectáculo en el sentido contemporáneo. En este trabajo se argumenta que no es posible contar objetos reales. Aunque a primera vista esta tesis pueda resultar desconcertante, o un simple ejercicio de «arte conceptual», las razones que la apoyan son fundadas y muy naturales. Se examinan algunas consecuencias importantes de dicha tesis y se ponen en conexión con diversos planteamientos de H. Putnam, P. Unger y E. Sosa.

In discussing the works of 16th-century theorists Francisco de Vitoria and Alberico Gentili, this article examines how two different conceptions of a global legal community affect the legal character of the international order and the obligatory force of international law. For Vitoria the legal bindingness of ius gentium necessarily presupposes an integrated character of the global commonwealth that leads him to as it were ascribe legal personality to the global community as a whole. But then its legal status and (...) its consequences have to be clarified. For Gentili on the other hand, sovereign states in their plurality are the pinnacle of the legal order(s). His model of a globally valid ius gentium then oscillates between being analogous to private law, depending on individual acceptance by states and being natural law, appearing in a certain sense as a form rather of morality than of law. Los avatares de Antoniana Margarita y el Endecálogo de Francisco de Sosa.

In this paper, I will examine the notion of an epistemic dilemma, its characterizations in the literature, and the different intuitions prompted by it. I will illustrate that the notion of an epistemic dilemma is expected to capture various phenomena that are not easily unified with one concept: while some aspects of these phenomena are more about the agent in a certain situation, other aspects seem to be more about the situation as such. As a consequence, incompatible intuitions emerge concerning (...) the transparency of epistemic dilemmas as well as regarding the role that doxastic suspension plays in resolving cases of epistemic dilemma. I suggest to distinguish between the mental state of agents who find themselves in an epistemic dilemma and the normative situation that gives rise to a dilemma. I will refer to the agent’s mental state as epistemic conflict and will reserve the term epistemic dilemma for evidential situations in which epistemic principles either recommend incompatible doxastic responses or render all options impermissible. The concept of epistemic conflict not only captures the mental state of agents who find themselves in a genuine epistemic dilemma but also applies to agents who face difficult epistemic choices that they cannot resolve without substantial cognitive (and often pragmatic) effort, for example, via doxastic suspension. This chapter takes up, in six sections, issues of realism and of ontological and conceptual relativity. Section 1 briefly lays out the kind of absolutist realism of interest in what follows. Section 2 considers arguments against ordinary commonsense entities such as bodies, and for the view that subjects enjoy a superior ontological position. No such argument is found persuasive. I find no good argument against ordinary bodies or other common-sense entities, nor any good argument that subjects enjoy any ontological superiority. (...) Section 3 lays out three options in ontology, opts for a kind of conceptual relativism, and takes up three problems for the proposed view. Section 4 then offers a compromise position based on a kind of existential relativity meant to accommodate our most settled beliefs about what there is, while retaining a fundamentally realist and objectivist ontology. The main argument of that section relies on a distinction between semantical relativity and ontological relativity. Section 5 defends my use of the semantical-ontological distinction against objections to it in the recent literature. Section 6, in conclusion, takes up arguments for the view that, as subjects of consciousness and thought, we must after all occupy a special ontological position in objective reality, one whose status remains mysterious. Divided into two parts this book examines the train of social theory from the 19th century, through to the `organization of modernity', in relation to ideas of social planning, and as contributors to the `rationalistic revolution' of the `golden age' of capitalism in the 1950s and 60s. Part two examines key concepts in the social sciences. It begins with some of the broadest concepts used by social scientists: choice, decision, action and institution and moves on to examine the `collectivist alternative': (...) the concepts of society, culture and polity, which are often dismissed as untenable by postmodernists today. In “Tracking, Competence, and Knowledge,” Ernest Sosa notes that in attempting to account for the conditions for knowledge, externalists have proposed that the justification condition be replaced or supplemented by the requirement that a certain modal relation be obtained between a fact and a subject's belief concerning that fact. While assessing attempts to identify such a relation, he focuses on an account labeled “Cartesian‐tracking”, which accounts for the relation in the form of two conditionals. If a person S believes (...) a proposition P → P P → S believes P. Sosa suggests that be abandoned as a requirement, and that, equipped with his modifications, can offer promising results in connection with skepticism. He argues that modified coupled with the requirement that S's belief be “virtuous” can illuminate the nature of propositional knowledge. (shrink)

In this paper, the relationship between the e-value of a complex hypothesis, H, and those of its constituent elementary hypotheses, Hj, j = 1… k, is analyzed, in the independent setup. The e-value of a hypothesis H, ev, is a Bayesian epistemic, credibility or truth value defined under the Full Bayesian Significance Testing mathematical apparatus. The questions addressed concern the important issue of how the truth value of H, and the truth function of the corresponding FBST structure M, relate to (...) the truth values of its elementary constituents, Hj, and to the truth functions of their corresponding FBST structures Mj, respectively. The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

This paper considers the place of reasons in the metaphysics of epistemic normativity and defends a middle ground between two popular extremes in the literature. Against members of the ‘reasons first’ movement, we argue that reasons are not the sole fundamental constituents of epistemic normativity. We suggest instead that the virtue-theoretic property of competence is the key building block. To support this approach, we note that reasons must be possessed to play a role in the analysis of central epistemically normative (...) properties, and argue that the relation of possession must be analyzed in terms of competence. But while we diverge with reasons-firsters on this score, we also distance ourselves from those who deny reasons any important role in epistemology. For we maintain that possessed reasons do help to ground deontic facts in the epistemic domain (e.g., facts about what one epistemically ought to believe, may believe, or is justified in believing). Indeed, we present an argument that the possession of sufficient epistemic reasons is necessary and sufficient for propositional justification, and that proper basing on such reasons yields doxastic justification. But since possession and proper basing are themselves grounded in competence, reasons are not the end of the explanatory road: competence enables them to do their work, putting them—and us—in the middle. Taking his critique of totalitarianizing conceptions of community as a starting point, this text examines Jean-Luc Nancy's work of an ‘ontology of plural singular being’ for its political implications. It argues that while at first this ontology seems to advocate a negative or an anti-politics only, it can also be read as a ‘theory of communicative praxis’ that suggests a certain ethos – in the form of a certain use of symbols (which is expressed only inaptly by the word ‘style’) (...) that would render the ontological plurality of singulars perceptible and practically effective. Finally, some recent texts by Nancy even sidestep the ontology of being-with and face the question of what politics, faced with demands of justice, could be and what a democratic politics could provide. Both of these aspects in Nancy's work, however, still remain to be spelled out more politically. (shrink)

Este estudio responde a características de programas grupales de educación parental que incluye, relación con la prevención/atención al abandono escolar temprano, enfoques y relación con la Parentalidad Positiva y grado de evidencias. Siguiendo el protocolo PRISMA 2020, se buscó en bases de datos y se aplicaron criterios de inclusión y exclusión detectando escasez de programas para promover la continuidad escolar y adolescencia; la necesidad de consolidarlos desde la Parentalidad Positiva y de implantar estándares de evaluación de evidencias (12 artículos). En (...) conclusión, informa para diseñar, implementar y evaluar estos programas de Parentalidad Positiva que promocionen competencias parentales y continuidad escolar. (shrink)

For an expression to be rigid means that it refers to one and the same thing with respect to any possible situation. But how is this in turn to be understood? An example will help us work through the definition. Take a word like ‘Aristotle.’ That word is a proper name; and proper names are a clear case of a type of word that refers. ‘Aristotle’ refers to a particular person, the last great philosopher of antiquity; in general, a name (...) refers to the thing of which it is the name. To continue working through the definition of rigidity, we need to make sense of referring with respect to. It is tempting, for example, but mistaken, to understand a word's referring with respect to a possible situation as it's being used, in that situation, to refer to something. (shrink)

In the 1920s, Carnap and Schlick both made an important use of definitions in their main publications: Schlick, in his Allgemeine Erkenntnislehre (1918, 2nd ed. 1925) and Carnap in Der logische Aufbau der Welt (1928, mostly written by 1925). In this paper, we first provide an analysis of the kinds of definitions that are distinguished in these books and a few other papers, and we then propose a systematic comparison of Schlick’s and Carnap’s diverging conceptions of definitions in the 1920s, (...) relating them, in both cases, to their respective philosophical projects in the Allgemeine Erkenntnislehre and in Der logische Aufbau der Welt.
